In this way, the European and humanist vocation of our University is also proven on this occasion. <\/p>\n\n<p class=\"wp-block-paragraph\">The general mission of the University is to generate and transfer knowledge through an intensive research process, to train students and researchers &#8211; active and responsible citizens &#8211; to promote education and research in line with the demands of a knowledge-based and values-based society, through initial training, continuing education and integration into the circuit of universal values.<\/p>\n\n<p class=\"wp-block-paragraph\">In order to ensure the security of personal data to the persons who entrust us with their personal data, UCDC implements a modern, flexible and secure system for collecting, processing, storing personal data, in compliance with the European and Romanian legislation in the field.<\/p>\n\n<p class=\"scroll wp-block-paragraph\"><strong>1. UCDC personal data controller<\/h4>\n\n<p class=\"wp-block-paragraph\">&#8220;Dimitrie Cantemir&#8221; Christian University of Bucharest (UCDC) is a private, autonomous institution of higher education and scientific research.  <\/p>\n\n<p class=\"wp-block-paragraph\">The University operates on the basis of the Romanian Constitution and Romanian legislation <em>(Law no. 88\/1993, Government Decision no. 568\/1995, Law no. 84\/1995, Law no. 238\/2002 and Law no. 1\/2011<\/em>) respecting the principles enshrined in international treaties and covenants on human rights, in the Magna Charta of European Universities and in the Bologna Declaration. The process of teaching and scientific research is organized and carried out in accordance with the principles of university autonomy, the University Charter and the requirements of the higher education system aligned with the Bologna Process. <\/p>\n\n<p class=\"wp-block-paragraph\">&#8220;Dimitrie Cantemir&#8221; Christian University has as its founders Prof. Momcilo Luburici and Prof. Corina-Adriana Dumitrescu (Radu), from whose initiative and with whose material and financial resources this private higher education institution was founded in 1990, under the name of &#8220;Dimitrie Cantemir&#8221; Independent University.<\/p>\n\n<p class=\"wp-block-paragraph\">The University operates under the auspices of the &#8220;Dimitrie Cantemir&#8221; Cultural Association The University also carries out activities related or complementary to teaching and research activities.<\/p>\n\n<p class=\"wp-block-paragraph\">The University is located in Bucharest, Splaiul Unirii 176, sector 4.  <br\/>The University Day is celebrated on February 10, the birthday of the President of the University, Prof. Dr. Momcilo Luburici, founder of the Christian University &#8220;Dimitrie Cantemir&#8221;, by organizing scientific, cultural and sports events<\/p>\n\n<p class=\"wp-block-paragraph\">In keeping with the traditions of European higher education, the University contributes to the scientific, professional and civic training of young people and to their integration into economic and social life, to the lifelong education of higher education graduates.<\/p>\n\n<p class=\"wp-block-paragraph\">Through its activity, the University has contributed and still contributes significantly to the compatibilization between the educational process in Romania and that of prestigious universities in Europe and worldwide. In this sense, UCDC has signed partnerships and collaboration agreements with universities in the European Union, USA, Turkey, China, Japan, etc. Students of all faculties of UCDC can benefit from mobilities within the Erasmus+ program of the European Union. <\/p>\n\n<p class=\"wp-block-paragraph\">The University has in its organizational structure 6 faculties based in two major university centers in the country: Bucharest and Cluj-Napoca.<\/p>\n\n<p class=\"wp-block-paragraph\">Currently, the educational offer of the University comprises <em>9 Bachelor&#8217;s degree programs <\/em>and <em>13 Master&#8217;s degree programs<\/em> in the following fields: <em>Business Administration, Accounting, Marketing, Law, Foreign Languages and Literatures, Education Sciences and Administrative Sciences<\/em>.<\/p>\n\n<p class=\"wp-block-paragraph\">The University offers the possibility to choose between <em>full-time (IF) and part-time (IFR) study programs<\/em>, each of them adapted to the needs, preferences and schedule of each student. The University <em>was institutionally evaluated<\/em> by the Agency for Quality Assurance in Higher Education in the academic year 2010-2011 (for the period 2010-2015), in the academic year 2014-2015 (for the period 2015-2020) and in the academic year 2021-2022 (for the period 2022-2027), successively obtaining the &#8220;<em>High Degree of Confidence<\/em>&#8220;, the highest qualification that can be awarded to a university in Romania. <\/p>\n\n<p class=\"wp-block-paragraph\">In 34 years of existence, more than 90.000 bachelor and master graduates have diplomas recognized by the European labour market.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>UCDC <\/strong>is a personal data controller as defined in Article 4(7) GDPR and <em>carries out operations or sets of operations, by which it processes personal data. Depending on the purpose of the processing, we inform you about the types of personal data processed, the purpose of the processing and the legal grounds on the basis of which it processes, stores and transmits personal data.<\/em> <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>UCDC <\/strong>has at the center of its concerns &#8211; in order to ensure the protection of personal data &#8211; the respect of all GDPR principles (cumulative):<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Lawfulness, fairness and transparency (the data are processed lawfully, fairly and transparently vis-\u00e0-vis the data subject);<\/li>\n\n\n\n<li>Purpose limitation (data is collected for specified, explicit and legitimate purposes and not further processed in a way incompatible with those purposes);<\/li>\n\n\n\n<li>Data minimization (data is adequate, relevant and limited to what is necessary in relation to the purposes for which it is processed);<\/li>\n\n\n\n<li>Accuracy (data are accurate and, where necessary, updated);<\/li>\n\n\n\n<li>Data are kept only in compliance with the legal terms in force;<\/li>\n\n\n\n<li>Security and confidentiality (data is processed in a way that ensures adequate security);<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">In ensuring compliance with GDPR, <strong>UCDC<\/strong> puts at the center of its concerns the protection of the rights of data subjects who entrust us with their personal data.<\/p>\n\n<h4 class=\"wp-block-heading scroll\" id=\"doi\">2. What types of personal data does UCDC collect?<\/h4>\n\n<p class=\"wp-block-paragraph\">The personal data collected by UCDC are necessary for the fulfillment of UCDC&#8217;s mission and the performance of UCDC&#8217;s contractual obligations. The request for these categories of data is based on the need for UCDC to comply with legal provisions. <\/p>\n\n<p class=\"wp-block-paragraph\">GDPR specifies that <em>&#8216;personal data&#8217; means any information relating to an identified or identifiable natural person (&#8216;data subject&#8217;); an identifiable natural person is a person who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to his or her physical, physiological, genetic, mental, economic, cultural or social identity.<\/em><\/p>\n\n<p class=\"wp-block-paragraph\">The generic types of personal data that UCDC generally requests from data subjects and which differ depending on the category of data subjects (employees\/teachers\/students etc) are:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>identification data: <em>name, surname, person&#8217;s name at birth (where applicable), National Identity Card (CNP), identity card number, passport number, home address, correspondence address, e-mail, telephone (landline, fax, mobile), online identifier, etc: required for employment, enrolment, health and safety at work, correspondence, etc<\/em><\/li>\n\n\n\n<li>data relating to studies completed or in the process of completion: <em>diplomas, transcripts, descriptive supplements, certificates, attestations, etc.: these are needed for employment, enrolment, health and safety at work, promotion, etc.<\/em><\/li>\n\n\n\n<li>data on occupation, nature of own work, data on past and present professional activity, as well as professional performance, seniority, experience, etc: <em>necessary for employment, pay determination, promotion, etc.<\/em><\/li>\n\n\n\n<li>special data: <em>medical data, disabilities; sick leave, employment, teaching activities, granting facilities<\/em><\/li>\n\n\n\n<li>financial data: <em>accounts opened with financial institutions, receipts, etc.; these are used for: payments of financial entitlements, payments of financial obligations.<\/em> <\/li>\n\n\n\n<li>data obtained from audio-video recordings of the physiognomy of data subjects accessing the premises of the UCDC guarded by the operator: necessary to meet the conditions relating to the guarding of objectives, goods and valuables and the protection of persons<\/li>\n\n\n\n<li>Identifying electronic addresses: (according to the cookie policy) <em>IP addresses, identifiers of local internet networks or hubs, geographical location, referrer source (from where the UCDC web page was accessed): statistical activity; Protection and security against intruders or against accidental or deliberate digital attacks<\/em>.  <\/li>\n\n\n\n<li>data concerning special situations: private\/family\/civil status\/dependants, data concerning legal or other situations: declarations, applications, certificates, various extracts<em>: necessary for declaring, informing, certifying personal situations, which have or may have an effect on contractual or employment conditions, respectively may influence material rights and\/or obligations<\/em>.<\/li>\n<\/ul>\n\n<h4 class=\"wp-block-heading\" id=\"trei\">3. What are the categories of persons to whom UCDC processes personal data (data subjects)?<\/h4>\n\n<ul class=\"wp-block-list\">\n<li>applicants to study programs;<ul><li>students<em> (bachelor, master), trainees in Conversion programs;<\/em><\/li><\/ul>\n<ul class=\"wp-block-list\">\n<li>employees: <em>teaching staff, associate teaching staff, auxiliary and non-teaching teaching staff, staff employed within the University or within the framework of projects financed by European funds, staff employed within research project teams;<\/em><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>collaborators: <em>service providers<\/em>;<ul><li>contractors: <em>suppliers of goods and services, participants in tenders, tenderers;<\/em><\/li><\/ul><ul><li>beneficiaries of UCDC hospitality services<em>(other than students and employees<\/em>);<\/li><\/ul><ul><li>beneficiaries of sports services (sports facilities, sports fields, etc);<\/li><\/ul><ul><li>visitors: <em>persons registered at access points and or filmed by video surveillance cameras, visitors to UCDC websites;<\/em><\/li><\/ul><ul><li>persons making requests for information or other petitions;<\/li><\/ul><ul><li>participants at conferences, summer schools, workshops, symposia;<\/li><\/ul><ul><li>persons publishing in UCDC journals;<\/li><\/ul><ul><li>library beneficiaries<em>(other than students and UCDC staff<\/em>);<\/li><\/ul><ul><li>reviewers of scientific papers (other than UCDC staff);<\/li><\/ul><ul><li>collaborating scientific researchers;<\/li><\/ul>\n<ul class=\"wp-block-list\">\n<li>persons carrying out verification and control activities at UCDC.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n<h4 class=\"wp-block-heading\" id=\"patru\">  4. What is the purpose of the processing of personal data by UCDC?<\/h4>\n\n<p class=\"wp-block-paragraph\">Processing shall mean any operation or set of operations which is performed upon personal data or sets of personal data, whether or not by automatic means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.<\/p>\n\n<p class=\"wp-block-paragraph\">The purpose of processing is closely related to the general and specific mission of UCDC &#8211; education, research and community services &#8211; but also in connection with the performance by UCDC of complementary activities: accommodation, food, renting of premises, sports and recreational activities, etc. Also, the data collected by the video surveillance system are necessary for the security of objectives, goods and valuables as well as the protection of persons. <\/p>\n\n<p class=\"wp-block-paragraph\">Essentially, the processing of personal data is carried out for all purposes provided for by Law no. 1\/2011 or its subsequent legislation, as well as for purposes deriving from the mission of the higher education institution or are closely related to this mission.<\/p>\n\n<p class=\"wp-block-paragraph\">Among the purposes of processing we list: carrying out admission, enrollment in study programs, carrying out educational activities, graduation, employment, promotion of staff, running commercial and service contracts to which UCDC is a party, carrying out scientific and publishing activities, granting facilities, etc.  <\/p>\n\n<p class=\"wp-block-paragraph\">As part of the process of prior information of the data subjects, the DPCU shall explicitly specify the purposes of the processing operations by categories of data subjects.  <\/p>\n\n<h4 class=\"wp-block-heading\" id=\"cinci\">5. What is the legal basis for the processing done by UCDC?<\/h4>\n\n<p class=\"wp-block-paragraph\">In accordance with <em>Regulation (EU) 2016\/679 of the European Parliament and of the Council of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95\/46\/EC<\/em> (GDPR), and with <em>Law No. 190\/2018 on measures implementing the GDPR and repealing Directive 95\/46\/EC<\/em> the main law that requires UCDC to process personal data is the National Education Law also known as Law No. 1\/2011 with subsequent amendments and additions.<\/p>\n\n<p class=\"wp-block-paragraph\">Other legal frameworks that require the UCDC to process personal data are related to the general functioning of the UCDC<em>(labor law, tax code, payroll, occupational safety and health, security and protection, granting of facilities,<\/em> etc.).<em><\/em><\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Internal Regulations: <\/strong>Dimitrie Cantemir Christian University Charter and other specific regulations.<\/p>\n\n<p class=\"wp-block-paragraph\">In addition to the legal grounds deriving from the obligation for UCDC to comply with the laws in force, UCDC may use as legal justification for the processing of personal data and the <em>informed consent of the data subjects<\/em> where the processing is based on art 6 lit a of the GDPR: <em>the data subject has given his\/her consent to the processing of his\/her personal data for one or more specific purposes.<\/em><\/p>\n\n<h4 class=\"wp-block-heading\" id=\"sase\">6. Who are the recipients and third parties to whom UCDC may transfer personal data?<\/h4>\n\n<p class=\"wp-block-paragraph\">The recipients and third parties to whom UCDCle may transfer certain personal data are public authorities or service providers that request such data, in accordance with the laws governing their activity, namely:<\/p>\n\n<p class=\"wp-block-paragraph\"><em>a. state authorities and public institutions, as a result of legal obligations of the Operator; <\/em><\/p>\n\n<p class=\"wp-block-paragraph\"><em>b. service providers directly\/indirectly involved in the educational activity and administration of www.ucdc.ro website<\/em> (e.g. <em>medical clinics with which UCDC<\/em><strong> <\/strong><em>has contracts, e-learning platform owners, IT service providers (maintenance, software development), archiving in physical and\/or electronic format; audit; transportation companies that provide the free\/ reduced transportation offered by specific legislation, the Romanian National Postal Company or various courier companies (for letter mail or dispatch of goods), banks with which teachers, employees and students have contracts for the payment of fees and the intermediation of payment by card of tuition and admission fees, etc.<\/em>);<\/p>\n\n<p class=\"wp-block-paragraph\">c.<em> judicial bodies in Romania and in other countries (EU, recognized by the EU as complying with the rules on the protection of personal data or having personal data protection agreements with Romania), as well as courts of law, public prosecutors <\/em><em>, notaries public, lawyers, bailiffs, translation offices, etc., if necessary<\/em><em> to central and local public authorities in Romania (e.g.: MAI, ANAF, ONPCSB, Competition Council, National Archives), police bodies; institutions investigating and supporting cybersecurity incidents, etc..<\/em><\/p>\n\n<p class=\"wp-block-paragraph\">d. third party providers of cookies and similar technologies as described in the Cookie Policy; in these situations, your personal data collected through cookies \/ similar technologies of third parties may be transferred to third countries (i.e. outside the European Union). The Controller may transfer personal data to countries outside the European Union or the European Economic Area. For such transfers, the Controller takes a number of measures to ensure an adequate level of protection of the personal data of individuals. These measures may include the conclusion of standard contractual clauses approved at European level. The transfer of data to third countries may also take place where it is necessary for the performance of a contract between you and the Controller or for the implementation of pre-contractual measures taken at your request, or where the transfer is necessary for the conclusion of a contract or the performance of a contract concluded in your interest between the Controller and another natural or legal person.<\/p>\n\n<p class=\"wp-block-paragraph\">UCDC has taken measures to ensure that, in the process of transferring personal data, their full security is ensured in accordance with GDPR.<\/p>\n\n<h4 class=\"wp-block-heading\">7. How long will your personal data be kept? <\/h4>\n\n<p class=\"wp-block-paragraph\"><em>The personal data &#8211; which has been or will be requested &#8211; will be provided by you and will be processed within a period of time provided for by European and national law, in accordance with the GDPR and other legal bases requiring it, respecting the principles of ensuring their security and respecting your rights. The archival nomenclature of <\/em><em>UCDC<\/em><strong> <\/strong><em>provides for each category of personal data their retention period.<\/em><\/p>\n\n<h4 class=\"wp-block-heading\">8. What are the rights of individuals who entrust us with their personal data?<\/h4>\n\n<ul class=\"wp-block-list\">\n<li>the right to be informed (art 13 and 14 of the GDPR)<em> &#8211; by <\/em><em>UCDC<\/em> <em>about the type, purpose, and legal grounds of the processing;<\/em><\/li>\n\n\n\n<li>the right of access to data (art 15 of GDPR)<em> &#8211; the individual has the right to obtain confirmation from <\/em><em>UCDC<\/em> <em>whether it processes personal data concerning him\/her<\/em>;<\/li>\n\n\n\n<li>  the right to rectification (art 16 <em>of GDPR<\/em>) &#8211; of personal data without undue delay;<\/li>\n\n\n\n<li>the right to erasure (&#8220;<em>right to be forgotten<\/em>&#8220;) &#8211; (art 17 of the GDPR) &#8211; to obtain from <em>UCDC<\/em> the erasure of personal data concerning you without undue delay, and <em>UCDC<\/em> is obliged to erase personal data without undue delay;<\/li>\n\n\n\n<li>the right to restriction of processing (art 18 of the GDPR) &#8211; when you consider that the personal data is inaccurate, or you consider that the processing is unlawful, or UCDC no longer needs this data;<\/li>\n\n\n\n<li>the right to notification of rectification or erasure of personal data or restriction of processing (art 19 of GDPR);<\/li>\n\n\n\n<li>the right to data portability (Article 20 of GDPR) &#8211; you have the right to receive the personal data concerning you that you have provided to UCDC in a structured, commonly used and machine-readable format so that it can be transmitted to another controller;<\/li>\n\n\n\n<li>the right to object (Art 21 of the GDPR) &#8211; you may object to the processing pursuant to Article 6(1)(e) or (f) or Article 6(1) of personal data concerning you, including the creation of profiles on the basis of those provisions;  <\/li>\n\n\n\n<li>the right not to be subject to a decision based solely on automated processing &#8211; including profiling (Art. 22) &#8211; which produces legal effects concerning you or similarly affects you to a significant extent;<\/li>\n\n\n\n<li>the right to lodge a complaint with the National Supervisory Authority for Personal Data Processing (art 15) &#8211; anspdcp@dataprotection.ro or <a href=\"https:\/\/www.dataprotection.ro\/?page=Plangeri_pagina_principala\" target=\"_blank\" rel=\"noreferrer noopener\">https:\/\/www.dataprotection.ro\/<\/a><\/li>\n<\/ul>\n\n<h4 class=\"wp-block-heading\" id=\"noua\">9. Does UCDC transfer data outside Romania?<\/h4>\n\n<p class=\"wp-block-paragraph\"><strong>The transfer of data<\/strong> can be made either on the basis of an adequacy decision issued by the European Commission on the basis of Art. 45 of the GDPR attesting that the third state meets those criteria, or on the basis of adequate safeguards, which may be provided by standard data protection clauses adopted by the ANSPDCP and approved by the Commission in accordance with the examination procedure, or may be provided by means of provisions to be included in an administrative agreement between the UCDC and the entity to which the data is transferred, which includes enforceable and effective rights for the data subjects, and which agreement must be authorized by the ANSPDCP.<\/p>\n\n<p class=\"wp-block-paragraph\">Data subjects will be informed no later than the date on which the data transfer is to be carried out. The purpose of these transfers is to facilitate the participation of UCDC students (e.g. ERASMUS program) and UCDC teaching staff in international mobility. <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>In order to fulfill the purposes of the processing made by <\/strong><strong>UCDC may transfer some categories of personal data outside Romania or EU\/EEA countries to: <\/strong><em>States to which the data subject&#8217;s consent for the transfer of data<br\/>or to other States (subject to appropriate safeguards such as standard contractual clauses or administrative arrangements to which UCDC is a party).<\/em><\/p>\n\n<h4 class=\"wp-block-heading\" id=\"zece\">10. Does UCDC have security measures in place for the protection of personal data processed through IT systems?<\/h4>\n\n<p class=\"wp-block-paragraph\">UCDC uses administrative, organizational, technical and physical methods to ensure the security of personal data both on the UCDC website and within the institution (servers, computer networks). Security measures are designed to maintain an appropriate level of data confidentiality, integrity and availability. The IT Directorate implements and manages systems to ensure the security of information systems.    <\/p>\n\n<p class=\"wp-block-paragraph\">UCDC has appropriate measures in place to ensure that the website users&#8217; data is protected against unauthorized access, use or modification, unlawful or accidental destruction or accidental loss.<\/p>\n\n<p class=\"wp-block-paragraph\">UCDC encourages members of the UCDC community to use the institutional e-mail service as well as the online learning and\/or e-learning platforms managed by UCDC in partnership with the providers on the basis of contracts with specific security and confidentiality clauses.<\/p>\n\n<p class=\"wp-block-paragraph\">However, we recommend any user to be aware that there is always a risk of transmitting information over the Internet and to manage this risk by adopting appropriate behavior.<\/p>\n\n<h4 class=\"wp-block-heading\">11. Does UCDC process personal data of minors? (persons under 16, as defined by the EU) <\/h4>\n\n<p class=\"wp-block-paragraph\"><strong>UCDC <\/strong>does not process personal data of persons under the age of 16 on a systematic basis. These data are collected through the video surveillance system on the basis of the legislation on the security and protection of objectives, goods, persons and valuables, during occasional or organized visits (Open Day, School Differently, etc.). <\/p>\n\n<p class=\"wp-block-paragraph\">The UCDC website does not knowingly collect information from users under the age of 16. How to obtain advice and lodge a complaint<\/h4>\n\n<p class=\"wp-block-paragraph\">To exercise your rights, with the exception of the right to lodge a complaint to the Supervisory Authority, as well as if you have any questions or concerns regarding the processing of your personal data, you may contact the Personal Data Protection Officer (DPO) of the Dimitrie Cantemir Christian University (UCDC) at the e-mail address dpo@ucdc.ro or by a request sent by courier\/mail or to the UCDC headquarters, Str. 176 Splaiul Unirii, sector 4, Bucharest, Romania.<\/p>\n\n<p class=\"wp-block-paragraph\">As part of these requests, please do not disclose sensitive personal data (information on religious beliefs, ethnic or racial origin or any other information related to health or trade union membership) when contacting us.<\/p>\n\n<p class=\"wp-block-paragraph\">The UCDC, through the DPO, shall respond to data subjects&#8217; requests without undue delay or shall give reasons to the data subject for the delay and, if it does not intend to comply with the request, shall give reasons for its refusal.
